Developer’s Warranty on New Build Properties
New build properties in Spain benefit from a range of legal guarantees provided by the developer under Spanish law, including the well-known 10-year structural warranty (“Seguro Decenal”).
This warranty offers important legal protection to buyers and specifically covers serious structural defects that may affect the stability, safety or structural integrity of the building, including issues relating to:
- Foundations.
- Structural walls.
- Beams and load-bearing elements.
- Structural construction defects.
In addition to the structural warranty, developers may also be responsible for certain construction or finishing defects during the legally established warranty periods applicable under Spanish building regulations.
However, it is important for buyers to understand that these guarantees do not cover:
- Normal wear and tear resulting from everyday use.
- Minor cosmetic issues arising after completion or handover.
- Damage caused by lack of maintenance or neglect.
- Problems resulting from improper use, modifications or alterations carried out by the owner or third parties.
For this reason, regular maintenance and proper care of the property are essential in order to preserve both its condition and long-term value.
At Windmill Group Spain, we believe it is important that buyers fully understand the scope and limitations of these warranties before purchasing a property. Our role is to provide clear and transparent guidance throughout the process, helping clients buy with complete confidence and peace of mind.
